Terms of Use

1. General

1.1 These Terms of Use / General Terms and Conditions (the „Terms“) apply to the use of the Jodel mobile app (the „App“) and the websites https://jodel.com and https://jodel-app.com (the „Websites“; collectively referred to as the „Services“) by you (the „User,“ „You,“ „Your“). The Services are provided by Jodel Venture GmbH, Wilhelmstraße 118, 10963 Berlin, Germany („Jodel,“ „we,“ „us“).

1.2 The App allows you to easily interact with other App users in your vicinity. In the App, you can share messages, images, and videos with other App users nearby. Additionally, you can view posts from other users in your vicinity and interact with them. The Services provided within the App include interactive features that allow users to publish content, including but not limited to text, images, and videos. Once you publish content in the App, other users can access it through the App or the Website. Further details about the App can be found on the Websites. Some features of the App may also be available on the Websites (particularly viewing posts from other users without creating an App account).

2. Creating an Account

2.1 To use the App, you must accept these Terms upon first opening the App. By accepting the Terms (generally by clicking the corresponding button), the User submits an offer to enter into a usage agreement for the App (the „Agreement“). Jodel accepts this offer by providing the corresponding App Services to the User. However, Jodel is not obliged to enter into such an Agreement with the User.

2.2 Only users who are at least 16 years old may register and use the App. You will be asked to confirm your age during the App registration process. If you are under 16 years old, you are not authorized to use the App. Additionally, the use of the Services is only permitted (i) if the User is a private consumer and (ii) for non-commercial purposes.

2.3 The use of the Services is free of charge for You.

3. Right to Use the App; Our Right To Use Your Content

3.1 Upon conclusion of the Agreement (see Section 2.1), Jodel grants you a limited, non-exclusive, non-transferable, non-sublicensable right to use the App for its intended purpose and for the duration of the Agreement, subject to the restrictions outlined in these Terms (see particularly Sections 4 and 6). This right is limited to personal, non-commercial use only.

3.2 You grant us permission to use the content you publish in the App („User Content“/ „User-Generated Content“), including content protected by intellectual property rights, to provide the App Services to you. In this context and for this purpose, we are entitled to display, use, distribute, modify, perform, reproduce, copy, publicly display, translate, or create derivative works from such User Content (collectively referred to as „Usage Rights“). This license is granted to us free of charge for the purpose of providing the App Services to you.

3.3 We are also entitled to use User Content on our social media pages (e.g., Facebook) and/or in other publications (e.g., books) that we may create and distribute, without you being entitled to any additional compensation. In such cases, we hold the corresponding Usage Rights.

3.4 If, in the future, the User is able to publish content on the Websites that corresponds to User Content (referred to as „Website User Content“), the aforementioned granting of Usage Rights to Jodel under Section 3.2 shall apply accordingly to such Website User Content.

4. Restrictions on the Use of Services

4.1 You may only use the Services and the content provided in the App and on the Websites for their intended purposes. Any other use of the Services not expressly permitted by these Terms is (i) prohibited and (ii) not covered by the license granted to you under Section 3.1 regarding the App. You must at all times comply with the usage restrictions and obligations set forth in Sections 4.2 to 4.3 and 6.

4.2 Users are prohibited from publishing the following content in the App and/or on the Websites:

    • Illegal or unlawful content
    • Content that is defamatory, offensive, libelous, morally objectionable, obscene, or pornographic, or that includes discrimination; content that constitutes a criminal offense and/or glorifies or incites (i) violence, (ii) terrorism, or (iii) racism
    • Content that includes hate speech or harasses other users of the Services
    • Content that contains personal data of others or makes others identifiable (including publishing images of other persons) unless (i) the other person has explicitly consented to the publication or (ii) there is a legal provision allowing such publication in individual cases without the person’s explicit consent
    • Unauthorized advertising for commercial products and services and/or conducting, promoting, or endorsing multi-level marketing or similar structures
    • Content containing spoilers for current TV series, movies, podcasts, audiobooks, books, or similar media
    • Content that infringes the intellectual property rights of third parties (such as copyrights or trademarks)
    • Content that includes trade secrets of third parties (at least when disclosure violates applicable law)
    • Content that insults or sexually harasses other users
    • False news (“fake news”)
    • Chain letters

e reserve the right to delete User Content and Website User Content that violates the provisions of Section 4.2.

4.3 By using the Services, Users agree to:

    • not to implement malicious programs in the Services or otherwise attack the Services and/or the users of the App with (i) data containing viruses, worms, Trojans or other malware and/or (ii) spam messages
    • not to perform any actions that could jeopardize the functionality and/or security of Jodel’s technical infrastructure for the Services (in particular actions that overload said infrastructure) and/or impair the appearance of the Services
    • not to create, build and/or operate any third party websites (e.g. (social media) fan pages), apps and platforms that consist entirely or largely of compilations of content published by other users in the App and/or on the Website (such user content also referred to as “Third Party Content”) without the express written consent of Jodel. If you are interested in operating a Third Party Platform (e.g. a Jodel fan page or similar platform), please contact us for approval before activating such Third Party Platform, as the creation, building and/or operation of such Third Party Platform may result in a cease and desist declaration and/or claims for damages being made against you (in particular) by Third Party Users of the Services and/or Jodel due to the violation of e.g. applicable (i) copyright law and/or (ii) the law against unfair competition)Not modify, alter, translate, reverse-engineer, decompile, disassemble, or decrypt the source code of the App or create derivative works based on the App (except to the extent permitted by law)
    • not to assist third parties in creating, building and/or operating third party platforms (such as, but not limited to, providing third party content to the operators of respective third party platforms) without the express written permission of Jodel
    • not to modify, alter, translate, reconstruct, decompile, disassemble or otherwise decipher the source code of the App or create derivative works based on the App (except to the extent that such actions are permitted under applicable law)
    • not to harass or cause harm to other users of the App
    • not to harass, intimidate, stalk or otherwise threaten other users of the App
    • not to use automation systems and/or software to extract data from the Services (including Third Party Content and Third Party Services Content (see definition in paragraph 6.1 below)), in particular if such data is used for commercial purposes and/or published on Third Party Platforms
    • not to assist third parties in extracting data from the Services (including Third Party Content and Service Content (see definition in paragraph 6.1 below)), in particular if such data is used for commercial purposes and/or published on Third Party Platforms
    • not to access the app accounts of other users without the authorization of the respective app users
    • to sell, rent, lease and/or offer products/goods and/or services in the app and/or on the websites
5. Additional User Obligations

5.1 You are responsible for the posts created by you or on your device. We cannot guarantee that all third-party content is true and accurate. In general, we do not proactively verify whether the content published by a user (i) is true and accurate and/or (ii) violates applicable law.

5.2 To prevent your device and/or your app account from being compromised by third parties (e.g., through malware), you must take all reasonable security measures. In particular, you must promptly install the latest updates for (i) your device (especially operating system updates) and (ii) the app.

5.3 If you become aware of security vulnerabilities in the services or significant violations of these terms by other users, we appreciate it if you report this to our support team (via the form in the app or on the websites).

6. Intellectual Property in the Services

6.1 The „Service Content“ is our property or the property of the respective licensor and is protected by copyright, trademark law, and/or other intellectual property protection regulations. „Service Content“ within the meaning of these terms includes all components of the services, i.e., data and materials, including images, graphics, illustrations, designs, icons, photos, texts, and other descriptions, excluding user content, website user content, and third-party content.

6.2 Any use and/or reproduction of the service content without our express prior consent constitutes a violation of applicable law and is prohibited under these terms.

7. Availability / System Failure

To the extent technically feasible and economically reasonable, we strive to provide the services 24/7. However, we cannot guarantee availability. Usage may be temporarily restricted due to capacity constraints, security or system integrity reasons, or to carry out technical maintenance necessary for the proper and/or improved provision of the services. In such cases, Jodel will take the legitimate interests of customers into account, e.g., by providing timely information (if possible).

8. Limitation of Liability

8.1 Jodel is liable to the user in accordance with the provisions of applicable product liability laws, in cases of intent and gross negligence, for injury to life, body, or health, if Jodel assumes any warranty, as well as in all other cases of mandatory statutory liability, in each case in accordance with legal provisions.

8.2 In the event of a breach of essential contractual obligations (so-called „cardinal obligations“), Jodel is liable to the user for the damages incurred. Cardinal obligations are obligations whose violation endangers the achievement of the contract’s purpose, as well as all obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance you can generally rely. However, if the breach of a cardinal obligation is due only to slight negligence and does not result in injury to life, body, or health, the user’s claims for damages are limited to the typical, foreseeable damage under the contract.

8.3 In all other cases, claims for damages against Jodel—regardless of their legal basis, in particular due to the violation of a pre-contractual duty or obligations arising from the contractual relationship between the user and Jodel by Jodel, its legal representatives, employees, or vicarious agents, or due to tortious acts—are excluded.

8.4 To the extent that Jodel’s liability is limited or excluded under Section 8, this also applies to the personal liability of Jodel’s legal representatives, employees, and vicarious agents.

8.5 All liability privileges, such as those under Sections 8–11 of the German Telemedia Act (TMG) or Section 598 of the German Civil Code (BGB), remain unaffected.

8.6 The above provisions of Section 8 do not result in any change to the burden of proof to the user’s detriment.

8.7 The user’s claims for damages expire upon the expiration of the statutory limitation periods, starting from the legal commencement of the limitation period.

9. Indemnification

The user agrees to indemnify, defend, and hold Jodel harmless from all losses, expenses, liabilities, damages, and claims (including reasonable attorney’s fees) arising from a culpable breach of the user’s obligations under these terms.

10. References to Other Websites / Content

To the extent that the services contain links and references to third parties, particularly to third-party websites, we have no influence on the current and future design and content of the linked websites and therefore cannot assume any liability. The use of content provided by third parties is at your own risk. If you become aware that we have linked to pages with illegal or questionable content, please inform us so that we can remove the link as soon as possible.

11. Data Protection

We collect, process, and use personal data as necessary in accordance with our privacy policy.

12. Suspension of Services for Users

Jodel may temporarily suspend the user’s access to the services, particularly in the following cases:

    • In the event of misuse or fraudulent use of the services by the user or in the case of a justified suspicion of misuse or fraudulent use of the services by the user;
    • If the user does not comply with the essential provisions of these terms of use (especially the provisions in Sections 4 and 6 above);
    • If the app is used on a smartphone where manufacturer-imposed restrictions or security functions have been bypassed or otherwise disabled; and/or
    • If Jodel is entitled to terminate the contract under Section 13 below.

For the duration of the suspension of a user’s access to the app, the license granted to the user under Section 3.1 will be terminated.

13. In-App Purchases

All payments related to the Jodel services are processed by independent app-stores and are subject to their respective terms of service, privacy policies, and payment policies. The Jodel Venture GmbH assumes no liability for any actions or omissions by these payment service providers.

13.1 Automatic Renewal
If you subscribe to an automatically renewing subscription, the corresponding fees will be continuously charged to account until you cancel the subscription in accordance to the respective app store policies. After the initial subscription period and each subsequent renewal, your subscription will automatically renew for the same period. If you do not wish for your subscription to renew automatically or if you want to modify or cancel your subscription, you must log into your respective app store account and follow the provided cancellation or modification instructions—this also applies if your account has already been deleted. It is not possible to change the subscription through Jodel itself.

13.2 In-App Items
As part of the Jodel services, you can purchase a limited, personal, non-transferable, non-sublicensable, and revocable license to use virtual in-app items or services (collectively: „Virtual Items“). The Jodel Venture GmbH may manage, regulate, modify, or remove Virtual Items at any time, with or without prior notice. Additionally, prices for Virtual Items may be updated at Jodel Venture GmbH’s discretion, and new Virtual Items may be added for additional fees. Jodel Venture GmbH assumes no liability towards you or any third party for exercising these rights. The transfer of Virtual Items is prohibited unless expressly permitted within the Jodel services. Except in cases explicitly allowed, you may not sell, exchange, or otherwise transfer Virtual Items to any natural or legal person, including but not limited to the company, other users, or third parties. The Jodel Venture GmbH reserves the right to change the prices of content offered through the Jodel services at any time. All information you provide in connection with purchases or other transactions must be accurate, complete, and up to date. You agree to pay all applicable fees at the prices in effect at the time of the transaction, including any applicable taxes.

13.3 Minors
Minors may only make in-app purchases with the consent of a legal guardian. By making a purchase, the user confirms that they are either of legal age or have the necessary parental consent. The Jodel Venture GmbH assumes no responsibility for unauthorized purchases made by minors. Parents and guardians are encouraged to implement appropriate safeguards in their app store settings.

14. Refunds for In-App Purchases

Refunds for in-app purchases in the Jodel app are generally only possible through the respective app stores (e.g., Apple App Store or Google Play Store) and are subject to their respective refund policies. The Jodel Venture GmbH does not offer direct refunds. Furthermore, there is no entitlement to a refund if a user violates the terms of use and their account is temporarily or permanently suspended as a result.

15. Termination of the Contract

The contract is concluded for an indefinite period. Either party may terminate the contract at any time with a notice period of two weeks. The contract will be automatically terminated if the user deletes the app from their mobile device. In addition, the right of both parties to terminate the contract for good cause remains unaffected. Jodel is entitled to terminate the contract without notice for good cause, particularly in the following cases:

  • In the event of misuse or fraudulent use of the services by the user or in the case of a justified suspicion of misuse or fraudulent use of the services by the user;
  • If the user does not comply with the essential provisions of these terms of use (especially the provisions in Sections 4 and 6 above); and/or
  • If the app is used on a smartphone where manufacturer-imposed restrictions or security functions have been bypassed or otherwise disabled.

17. Miscellaneous

17.1 The current version of the terms of use can be viewed, printed, and/or downloaded as a PDF file on the websites.

17.2 Under certain circumstances, Jodel may need to modify and/or supplement these terms of use (e.g., in the event of changes to the legal regulations applicable to the app). In such cases, Jodel will inform the user appropriately about the corresponding changes to the terms. When using the app, this will generally occur when the user (re)opens the app. The user will then be asked to accept the amended terms. If the user does not accept or refuses to confirm the amended terms, (i) the user has the right to immediate termination for good cause in accordance with Section 13 above, and (ii) Jodel has the right to (a) immediate termination for good cause in accordance with Section 13 above, provided that such termination appears necessary for Jodel and does not unfairly disadvantage the user, and (b) restrict the user’s access to the app in accordance with Section 12 above, provided that such restriction appears necessary for Jodel and does not unfairly disadvantage the user. Jodel will inform the user of the possible consequences of rejecting the amended terms of use when notifying them of the changes.

17.3 Jodel is neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.

17.4 These terms of use are governed by the laws of the Federal Republic of Germany.

17.5 If any provision of these terms of use is or becomes invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision must be replaced by an enforceable provision that comes as close as possible to the economic purpose of the invalid provision. The same applies in the event that these terms of use contain gaps in regulation.
